CreativeCapital – Terms & Conditions
CreativeCapital is the trading name of Creative Capital Arts Limited, a charity (registration number 1132100) funded by Arts Council England and company limited by guarantee (registration number 5237835).
Its core purpose is to:
• provide individuals with the artistry to develop their creative practice or career
• organisations with an essential platform to increase the reach of their services.
CreativeCapital is committed to protecting your privacy. This privacy policy describes the ways in which it will collect information from you when you use the service, and what it may use it for.
A. Assent to terms of privacy policy
By using CreativeCapital’s website and e-digest services you acknowledge that you have read the terms & conditions and that you agree to us using user data for the purposes set out below. The Terms & Conditions may be amended by CreativeCapital at any time in which case you be will be notified.
B. General
Internally within CreativeCapital, the organisation may make user data available to its staff members or third party agents such as web developers, either for the fulfilment of CreativeCapital’s services or to enable them to provide you with information about relevant products or services which they believe would be of interest to you.
C. Legal
While it is unlikely, CreativeCapital may be required to disclose your user data by a court order or to comply with other legal requirements. In this case we will use all reasonable endeavours to notify you before we do so, unless we are legally restricted from doing so.

F. Virus Protection
1. Material that you post must not contain links to ‘browser bomb’ sites (that open up multiple windows) or sites containing material that fall within clause E above.
2. You agree that you will not post content, the display of which would infringe the intellectual property rights of any third party. In particular, you warrant that the content of your posting is original and not copied from any third party.
3. You agree that you will not use postings to offer items or services for sale or place advertisements for goods, products or services of third parties.
4. If you breach any of the provisions set out in this these Terms & Conditions then CreativeCapital may immediately terminate your use of the service.
5. CreativeCapital reserves the right not to circulate any material that you post in its absolute discretion.
6. You consent to CreativeCapital monitoring your posting prior to distribution.
7. You consent to CreativeCapital editing any posting it receives from you for the sole purpose of making it accessible, grammatically accurate or to correctly fit within the overall ‘professional development’ tone of voice and theme of the service. You should ensure that all material has been thoroughly proof-read and checked for 'plain English' prior to submission.
G. Limitations of Use
1. The postings you read and receive from CreativeCapital (the "Content") may be used only for your personal, non-commercial purposes. You agree not to modify, copy, reproduce, retransmit, distribute, sell, publish, broadcast, create derivative works from, or store the Content (or any portion thereof).
2. No link to any part of CreativeCapital website may be made from another website or distributed by email without the prior written permission of CreativeCapital.
H. Linking
CreativeCapital may have links to other websites. CreativeCapital is not responsible for the content, nor does it warrant the accuracy or reliability, of any linked website. CreativeCapital to the extent permissible by law excludes all liability which may arise from your use or reliance on the information or contents contained in the linked site.
I. Governing law
These Terms & Conditions and your use of the services shall be governed by and construed in accordance with English law and the English Courts shall have exclusive jurisdiction in connection with all matters relating to these terms and conditions of use.

The copyright in the contents of the service is owned by CreativeCapital and/or its Members and suppliers.
K. Disclaimer
1. CreativeCapital will endeavour to ensure that information provided in both its website and e-digest is accurate at the time of posting. Unfortunately it cannot guarantee the accuracy of contents or information contained in its pages and any person using information contained in them does so entirely at their own risk.
2. The views and opinions expressed in the content as provided by its Members or suppliers are not those of CreativeCapital. No endorsement is made by CreativeCapital of accuracy or completeness of the content.
